NOTICE OF FORECLOSURE Default having been made in the payment of the indebtedness secured by that certain mortgage dated February 8, 2002, executed by Matthew Kontzen, husband and Candice Kontzen, wife, to New South Federal Savings Bank, which mortgage was recorded on February 11, 2002, in Book 1231, Page 404, of the mortgage records in the Office of the Judge of Probate of Cullman County, Alabama, which mortgage was, duly transferred and assigned to Chase Manhattan Mortgage Corporation, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the Main entrance to the Cullman County Courthouse at Cullman, Alabama, during the legal hours of sale on April 26, 2016, the following described real estate, situated in Cullman County, Alabama, to-wit: All that part of the North half of the Northwest Quarter of the Northwest Quarter of Section 26, Township 9 South, Range 1 West more particularly described as; beginning at the Northwest corner of said Section 26; thence due East along an agreed fence line 1134.51 feet to a rebar iron set on the West right of way of the Holly Pond Baileyton State Highway (County Road 1718); thence South 5 degrees 14 minutes 35 seconds East along said right of way 200 feet to a set rebar iron and the true point of beginning of the property herein described; thence from said true point of beginning continue South 5 degrees 14 minutes 35 seconds East along said right of way 220 feet to a set rebar iron; thence due West 210 feet; thence North 5 degrees 14 minutes 35 seconds West 220 feet to a set rebar iron; thence due East 210 feet to the true point of beginning. This sale is made for the purpose of paying the indebtedness secured by said mortgage as well as expenses of foreclosure. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the County where the above-described property is situated.
